The Code of Conduct for U.S. Judges requires federal judges to perform the duties of the office “fairly, impartially and diligently.”

But is this just empty rhetoric?

Minority Leader Chuck Schumer, D-NY, on Friday said Democrats placed 235 “progressive judges” on the bench in 2024 who are working to thwart GOP President Donald J. Trump’s agenda.

“We are in over 100 lawsuits against them [the Trump administration] and we are having a good deal of success,” said Schumer.

The comments by Schumer, who has held a top leadership position in the Democratic Party for years, cannot be merely dismissed as ill-advised. He is speaking to fellow Democrats, who have criticized the party’s leadership in recent weeks for failing to more aggressively combat Trump’s agenda.

Attorney General Pam Bondi says federal judges issued 14 nationwide injunctions against the Trump administration in February alone, and 160 “resistance” lawsuits are in the pipeline. She called this a “clear concerted effort by leftists” to oppose or slow down Trump’s agenda.

Of the 64 injunctions issued against Trump’s policies, 92.2% were issued by Democrat-appointed judges - Harvard Law Review

Both parties say the conflict between the judicial and executive branches has caused a constitutional crisis. Schumer blames a “lawless” Trump while Republicans blame a “judicial coup.”

It is just a question of time before the clash is unavoidable for one or both parties.
