Pres. Biden's Dictate On Trans Rights Achieved What Scotland Failed To Do
Britain has vetoed Scotland's Parliament's plan to make it easier for Scots to change their gender, something that Pres. Biden okayed with the stroke of a pen on his first day in office in 2021.
The United Kingdom recently vetoed a law passed by the Scottish Parliament that would have allowed transgender people to have the gender with which they identify legally recognized without a medical diagnosis.
This is what happens when you go through bothersome law-and-order stuff.
It’s so much easier to do what Pres. Joe Biden did on his first day in office.
With the stroke of a pen, Pres. Biden unilaterally declared that men who “identify” as women are women. He effectively did what Scotland tried to do without the inconvenience of public notice.
Scotland’s proposal led to months of fractious debate and opposition by women around the world.
The Scottish proposal permitted anyone 16 and older who declares they are living in their “acquired gender” and intend to do so permanently to be issued a new birth certificate without a medical diagnosis.
Opponents, mostly women, said allowing biological men to simply change their gender creates a potential threat to women and girls. They said men may say they identify as women to gain access to women’s private spaces when they are really intent on harassment or worse.
British Prime Minister Rishi Sunkar blocked the bill, finding the Scottish legislation was in conflict with U.K.- wide equality laws that apply across Britain.
Pres. Biden’s Executive Order avoided all that trouble and strife.
He simply announced that biological men who “identify” as women are women and must be treated accordingly. His executive order declares that “ [c]hildren should be able to learn without worrying whether they will be denied access to the restroom, the locker room, or school sports.”
The EEOC, U.S. Dept. of Education, U.S. Bureau of Prisons all responded to Biden’s order with “guidance documents” that require biological men who identify as women to be treated as women.
So males of any age in the U.S. who “identify” as women can use women’s restrooms and locker rooms and to play on female sports teams, be housed in women’s prisons and women’s shelters, etc.
Enshrined?
Pres. Biden tells us that equality for biological men who “identify” as women is “enshrined in our Nation’s anti-discrimination laws.”
This is bollox as the British would say. (An English term meaning to throw into confusion.)
The “right” of biological men who “identify” as women to use women’s restrooms is not remotely enshrined in our nation’s Constitution and was never envisioned in Title VII of the Civil Rights Act of 1964. It was not until 1980 that the term “transexualism” even appeared in the Diagnostic and Statistical Manual of Mental Disorders and it was thought to be a mental disorder.
The concept of allowing biological men to participate on women’s sports teams is contrary to the spirit of Title IX of the Education Amendments of 1972, which says women cannot be excluded from participation in or denied the benefits of any educational programs (including sports) that receives federal financial assistance.
But whether you support trans rights or not, isn’t it reasonable to have a discussion before giving it the force of law?
U.S. Women lost the battle without being allowed to a single sentence in opposition.
Biden’s executive order is a breathtaking slight of hand. He claimed in his executive order that the U.S. Supreme Court granted trans people equal rights when it passed Bostock v. Clayton County in 2021. This is demonstrably false…
