Iowa Supreme Court Says Sex And Gender Identity Discrimination Are Different
Court rejects U.S. Supreme Ct analysis in landmark case, Bostock v. Clayton County.
The Court noted Iowa’s civil rights law provides separate protections based on gender identity and sex. Even though its state statute must be read broadly, the Court said the “ordinary meaning” of sex does not include “gender identity.”
“We may not through the judicial metamorphosis of words declare a Hulk where the legislature placed merely Bruce Banner,” writes the Court.
