Appeals Court Deals A Heavy Blow To Biden's 'Transgender" Initiative

The Court held the U.S. Dept. of Education did not give 20 complaining states an opportunity to challenge its 'guidance' holding that LGBTQ+ are protected under Title IX.

The U.S. Court of Appeals for the Sixth Circuit in Cincinnati, OH, Friday temporarily halted enforcement in 20 states of a Biden administration “guidance” stating that Title IX prohibits discrimination based on sexual orientation and gender identity.

The 2021 guidance, issued by the U.S. Dept. of Education (DOE), allows trans (males) to play on female sports teams and to use female locker rooms and restrooms.

A panel of three appellate judges, in a 2-1 ruling, faulted the DOE for “skipping the notice-and-comment process” that would have given states a chance to object to its Title IX policy.
